Mason v. Peabody & Arnold, LLP

The Plaintiffs alleged an attorney at the Massachusetts law firm of Peabody & Arnold, LLP committed malpractice in preparing testamentary documents. Dick Caldwell and Mike Forte of Rumberger, Kirk & Caldwell argued the Florida court had no personal jurisdiction over Peabody & Arnold for two reasons. First, the firm's activities did not fall within Florida's long-arm statute. Second, the firm did not have sufficient minimum contacts with Florida such that it would expect to be sued in Florida. The court agreed, quashed the service of process against Peabody & Arnold and dismissed the Complaint.
