Austin v. Sears Home Improvement Products, Inc.


The plaintiff claimed water intruded into her house by way of defective siding, resulting in mold growth. She attributed various medical complaints to the mold, including sinus problems and memory difficulties. Rumberger, Kirk & Caldwell attorney Michael Forte filed a motion for partial summary judgment on these personal injury claims, arguing the plaintiff had insufficient evidence to establish a causal link between the mold and the alleged injuries. The court agreed and granted final partial summary judgment.
