Arguing Motions with Passion and Poise

Week 6

On Monday, I worked on drafting an outline for the Motion Practice Workshop which I based on my Daubert motion from the writing competition. I enjoyed preparing for the workshop because after all of the research, writing, and editing I did in writing the motion, I couldn’t wait to finally argue the motion. Malina and I attended a special set hearing with partner Suzanne Singer. It was great to watch Suzanne in action as she argued about the case’s crucial facts and legal arguments.

A fresh mango right off the tree from Partner Steve Smith!

On Tuesday, I attended the Motion Practice Workshop, where I received great feedback from partners Dan Gerber and Steve Klein about how I argued my Daubert motion. I was thrilled to learn about ways I can improve my oral advocacy skills in anticipation of the upcoming mock trial. I also worked on analyzing case law for Suzanne and attended another hearing, this time with partners Steve Smith and Michael Holt. I enjoyed being able to work on different cases throughout the day because it allowed me to work with different individuals per assignment!

On Wednesday, I worked on drafting two motions to dismiss for partners Michael Holt and Scott Sarason. These were interesting to work on because they involved differing causes of action. I also worked on an assignment for Jessica Kerbel (my awesome mentor), which was great to work on because I learned more about a potential statute of limitations defense issue within the case. Jessica talked to me about more details about the case that were pertinent to our defense—I learned a ton!

On Thursday, I drafted a third motion to dismiss for Michael and Scott. At the weekly attorney luncheon, Malina presented two intriguing cases involving indemnity provisions. It was insightful to learn about the nuances of when an indemnity provision will be honored. After lunch, I worked reviewed the mock trial case packet. And, just like that, it was the 4th of July and the week had flown by!
