Pandemic: Business Interruption Claims in the Face of COVID-19

The global health emergency caused by COVID-19 has either disrupted or completely interrupted business operations across the United States.  The financial impact of government-mandated shutdowns on businesses is substantial and multiplying each day for many enterprises.  Consequently, insurers are now navigating a wave of claims for losses due to the business interruption of shelter-in-place orders. 

Jacey Kaps and Brett Carey explored the principal arguments for and against coverage of business interruption claims related to the COVID-19 pandemic during a webinar for American Educational Institute Claims Education Conference webinar on May 1, 2020.

During the presentation, they offered the following key points to help insurers navigate the multitude of business interruption claims they are receiving:

  1. Review your policy to see what exclusions are included;
  2. If you receive claims, handle those claims just as you would other claims in terms of responding to the insured;
  3. Pay attention to government- nationwide and statewide, alerts and changes; and
