RumbergerKirk Partner featured speaker for Medicare Secondary Payer Act Webinar

RumbergerKirk partner Jacey Kaps is the featured speaker for a webinar hosted by the Florida Retail Federation. Kaps will present on the topic “NO ESCAPE: The Medicare Secondary Payer Act WILL Affect You!”

Beginning January 1, 2010, insurers and self-insured entities will be required to report claims made by Medicare-eligible claimant/plaintiffs to the Centers of Medicare and Medicaid Services (“CMS”) and will be subject to a $1,000 daily fine, plus “double damages” for failure to comply. Additionally, under recent changes to the Medicare Secondary Payer Act, compliance may not end with identification, settlement, timely reporting and payment. Currently it is unclear whether the insurers or insurance carriers have an affirmative duty to Medicare after the case is settled and reporting is complete. That could mean companies would be exposed for ongoing claims in perpetuity.
