Richard Greenberg represented an individual charged with cultivation of marijuana and possession of a firearm by a convicted felon. After reviewing the affidavit in support of the search warrant, Mr. Greenberg filed a motion to suppress evidence. The motion argued the law enforcement officer who obtained the search warrant failed to tell the judge who signed the warrant all of the material facts. In particular, the officer failed to inform the court that the residence to be searched had an enclosed garage, which significantly changed the amount of electricity used at the residence. After a hearing on the motion to suppress, the trial court granted the motion. The State Attorney’s Office then dismissed all charges against Mr. Greenberg’s client.
